TERMS & CONDITIONS

 

 

All business transactions by Premier Garden Products Limited (the Premier Garden Products Limited) with its customers (the Buyer/s) is in accordance with the Terms and Conditions of Trade set out in this document. There shall be no amendment, variances or changes to the Terms and Conditions of Trade unless agreed between the parties in writing.  By the placement of an order by the Buyer for products supplied by Premier Garden Products Limited, it is deemed that the Buyer agrees to purchase such products in accordance with the Premier Garden Products Limited Terms and Conditions of Trade as set in this agreement.

 

PRICE:

 

Unless otherwise agreed in writing, all goods will be supplied by the Premier Garden Products Limited to the Buyer at £ sterling prices as set out in the Premier Garden Products Limited price list/web site.

 

PAYMENT TERMS:

 

Payment can be made by recognised providers of the following Credit and Debit Cards. Mastercard, Visa, Visa Electron, Switch, Delta and Solo.

 

DELIVERY CHARGE:

 

All home deliveries are “free of charge” as at 1st January 2007, For deliveries in Ireland, Channel Islands and parts Wales, Scotland and Cornwall the Buyer must contact the Premier Garden Products Limited to confirm additional transport costs to these regions. Details of the increased scaled charges will be made available for the Buyer to view. Single box items under 30kg will be sent via DHL..       

 

PREMIER GARDEN PRODUCTS LIMITED’S RIGHT TO WITHHOLD, DELAY OR CANCEL AN ORDER:

 

Premier Garden Products Limited has a right to Withhold, Delay or Cancel delivery of an order on behalf of the Buyer without any liability claims for whatsoever reason.

 

CLAIMS FOR SHORTAGES ON DELIVERY:

 

Any Claims for shortages on the delivery must be notified by the BUYER by telephone and written confirmation by email no later than 24 hours from date of delivery of goods. The final consumer must note any shortages on the proof of delivery. It is the responsibility of the Buyer to ensure that the consumer signs the proof of delivery correctly. Failure to notify the Premier Garden Products Limited within 24 hours will result in such a claim not being accepted.

 

CLAIMS FOR DAMAGES:

 

In the event of a claim for damaged items, the BUYER must inform PREMIER GARDEN PRODUCTS LIMITED within 48 hours of delivery. Information of the date, damage and cause including a photograph detailing the damaged item must be notified to PREMIER GARDEN PRODUCTS LIMITED in writing by post or email. Failure to provide this information within 48 hours will result in the claim not being accepted. Premier Garden Products Limited has the right to supply goods/items or spare parts to repair the item free of charge (provided the claim is legitimate) to settle such claims. If replacement cannot be made available or deemed not economically viable then, the Premier Garden Products Limited will issue a credit note or refund to the Buyer as settlement.

 

PROCEDURE FOR CLAIMS IN CASE OF CUSTOMER RETURNS  (GARDEN FURNITURE ONLY):

 

In the event that an item is faulty upon use; It is a condition of supply by Premier Garden Products Limited to the Buyer that if such an item is from a set, a replacement item/spare part will be provided free of charge within a reasonable period but not the entire set. Information of the date, damage and cause including a photograph detailing the faulty item must be notified to PREMIER GARDEN PRODUCTS LIMITED in writing by post or email prior to any replacement being provided. Failure to provide this information will result in the claim not being accepted. The Buyer must co-operate with Premier Garden Products Limited to make sure that the buyer did comply with the Product Care and Maintenance instructions relevant to the item.

 

PROOF OF DELIVERY:

 

The Delivery Note signed by the customer at the delivery address is the proof of delivery. The signature on the delivery note must match the name on the order. The Buyer should make Premier Garden Products Limited aware before delivery, if the name of the person signing for the delivery will not be the same as on the order, and also inform Premier Garden Products Limited of the name of the person who will sign via email. If the name on the proof of delivery does not match the name on the order, Premier Garden Products Limited have not been informed of a different signing party via email; all rights to claim on shortages and damages upon delivery are void. It is the responsibility of the Buyer to ensure that the consumer signs the delivery note correctly.

 

REQUEST FOR PROOF OF DELIVERY:

 

Must be made in writing within 7 days of receipt of invoice. No claims will be accepted after this date.

 

CANCELLATIONS:

 

Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of any of these items within a period of 7 working days, beginning with the day after the day on which the item is delivered. This applies to all of our products. However, we regret that we cannot accept cancellations of contracts for the purchase where the item has been unsealed. Orders cancelled by the Buyer after the goods have been dispatched from Premier Garden Products Limited are subject to a delivery and return charge to be invoiced to the Buyer. Delivery and return charges match the scaled charges for delivery. Example: An order that is cancelled after dispatch that costs £35 to deliver will be invoiced to the Buyer at £70 plus V.A.T. where £35 is to deliver plus the £35 cost of returning the goods to Premier Garden Products Limited.

 

General cancellation terms. The Buyer must cancel orders in writing by email within 24 hours of placing the order. Orders cancelled by the Buyer after the goods have been dispatched from Premier Garden Products Limited are subject to a delivery and return charge to be invoiced to the Buyer. Delivery and return charges match the scaled charges for delivery. Example: An order that is cancelled after dispatch that costs £35 to deliver will be invoiced to the Buyer at £70 plus V.A.T. where £35 is to deliver plus the £35 cost of returning the goods to Premier Garden Products Limited.

 

COLLECTIONS:

 

The Buyer should inform Premier Garden Products Limited to arrange a collection via email. Premier Garden Products Limited will then arrange collection through a third party carrier. Collection charges are scaled the same way as cancellations charges and will be invoiced to the buyer following collection. Where collections are attempted but unsuccessful the Buyer will be charged again at the relevant rate for the attempted collection. A collection is deemed unsuccessful when a specific date for collection is arranged and the carrier attempts to collect and there is nobody at the specified address to provide the carrier with the items. Once the order has returned to Premier Garden Products Limited the Buyer will be credited for the items that have returned in saleable condition. Initial delivery charges from the collected order will not be credited. Should items not be returned in saleable condition (which means in complete original packaging), the Buyer will not be credited for these items. Premier Garden Products Limited will provide photographs of collected items that are deemed not to be in saleable condition should the Buyer require. 

 

ORDER DETAILS:

 

The Buyer must transmit the following details to Premier Garden Products Limited when placing every order:

 

-          Name of Order Recipient.

-          Delivery Address including postcode.

-          TWO contact telephone numbers.

-          An email address.

-          Product description and quantity required. 

 

Orders can be placed via fax or email. Premier Garden Products Limited takes no responsibility for delays, extra charges or cancellations that occur as a result of missing details from the above list.

 

RETENTION TO TITLE:

 

Title to all goods supplied by Premier Garden Products Limited shall always remain with Premier Garden Products Limited until the time that all corresponding outstanding invoices are paid by the Buyer to Premier Garden Products Limited. This hereby entitles Premier Garden Products Limited to contact the customer to collect all delivered items should the Buyer default with payments.
